In order to provide for such evaluation, COMPANY hereto agrees to the following terms and conditions: (1) The above recitals are true and accurate and form a part of this Agreement. (2) The COMPANY shall not manufacture or copy dBrush Products, nor in any way infringe upon dBrush Products. Under no circumstances shall COMPANY at any time use dBrush Products trade names, trademarks or other proprietary information as part of COMPANY's corporate or trade name.
